Just a comment about (I believe_ the May 13 trials/tribulation dispatch [podcast])...You mentioned that defense could argue the state was not harmed (tax-wise) with Cohen’s hush money reimbursement, because the value was “grossed up” so the reimbursement to Cohen would also cover the tax he would need to pay on the “income”. However, I don’t believe this is relevant to the case. I’m no expert in US or New York tax law, but I’m guessing state and federal law limits the list of items which can be claimed as legitimate expenses to reduce a business’s (or person’s) taxable income. I believe the alleged crime is that Trump (and/or his business) claimed a tax reduction for an expense which cannot be lawfully used to reduce personal or business taxable income. For example, if I am a landlord, I can legitimately reduce the tax effect on the rental income via expenses such as repairs, agent’s fees etc. that are directly connected to the costs of the income-producing property. I would be surprised if ANY tax jurisdiction allows a business or person to claim that “hush money for an affair” is a legitimate tax-reducing expense. Whether Cohen paid his own tax correctly to get his full reimbursement is irrelevant. The alleged crime must be that Trump reduced HIS tax by stating something was a legitimate tax-reducing expense (such as legal expenses of running his business), when it was not. I have no idea why these clowns did not simply do it as a loan/repayment. Getting or giving a loan is not "income" OR "expense". Neither is repaying it. Cohen could simply have loaned Trump $130k and then Trump repay it. But, no doubt, Trump was "allegedly" trying to pretend every single check he signed was a tax-reducing expense.
